Terms of Service – “Love Places”

1) Scope and Provider
These Terms of Service govern the use of the mobile application “Love Places” (the “App”).

Age limit: The App is intended for users 16 years and older.
2) App Description
The App allows you to:
- create and save places as pins on a map,
- rate, categorise and add notes to pins,
- create groups, share pins and post comments,
- receive push notifications about group/app activity.
The App is free and funded by advertising. Maps are provided by Apple Maps(iOS) and Mapbox(Android). Your current GPS position is not stored or synced by us; it is used only for live display. For details on data processing, please see our Privacy Policy.
3) Access and Account
3.1 Requirements
- iOS or Android device with a supported version and internet connection.
- An account is required for sync, groups and comments.
- Registration/sign‑in via Sign in with Apple(iOS) or Google Sign-In(Android).
3.2 Registration and Account Security
- Provide truthful information; one account per person.
- Keep your credentials and device secure; activity via your account is attributable to you.
- Accounts are non‑transferable.
3.3 Account Termination
- You can delete your account at any time in the App under Profile → Delete account.
- We may suspend or delete accounts for violations of these Terms.
- Upon deletion, personal profile data will be deleted/anonymised; shared content may persist without personal reference (e.g. as “Deleted user”) to preserve group history.
4) Licence to Use the App
We grant you a non‑exclusive, revocable, non‑transferable licence to use the App on compatible devices for private, non‑commercial purposes. Reverse engineering, circumvention of security measures, resale/sub‑licensing, and automated access are prohibited. Updates may modify or remove features.
5) Acceptable Use
You must not use the App to:
- post illegal, abusive, hateful, discriminatory or pornographic material;
- infringe third‑party rights (e.g. privacy/property at private places) or incite unlawful acts;
- conduct spam, advertising or commercial activity without our consent;
- upload malware, attempt to bypass security, or perform automated scraping;
- misrepresent locations or publish content that could endanger others.
We may remove content and/or suspend accounts in case of violations.
6) User‑Generated Content (Pins, Comments, Images)
- Your rights remain with you: you keep the IP rights in your content.
- Licence to us: by uploading, you grant us the rights necessary to store, technically reproduce, display within the App, adapt for technical reasons, and share with group members, solely to operate the App; non‑exclusive and worldwide.
- Responsibility: you warrant your content does not infringe rights of others, does not disclose personal data of third parties without consent, and does not unlawfully reveal private locations.
- Moderation: we may remove content that violates law or these Terms.
7) Groups
- Groups are created/managed by users; creators may add/remove members and moderate content.
- Invite/join codes must be kept confidential; misuse is prohibited.
- Members can leave groups at any time; we may remove users from groups upon violations.
8) Location, Maps & Safety
- Location access is voluntary via iOS/Android system permissions; your live position is not stored by us.
- Pins are user‑chosen place data (content) and may be stored/shared.
- Maps are provided by Apple Maps (Apple Inc.) and Mapbox (Mapbox Inc.). The App is not a navigation service; use at your own risk. Respect laws and private property.
- When using the Android version, Mapbox services are subject to Mapbox’s Terms of Service (https://www.mapbox.com/legal/tos).
9) Advertising, Tracking & Notifications
- Ads are served via Google AdMob; personalised ads only with your consent. Non‑personalised ads may be shown.
- Push notifications are sent only with your consent and can be disabled in iOS settings.

10) Availability, Maintenance & Changes
We aim for high availability but cannot guarantee uninterrupted service. Maintenance, tests or third‑party outages may affect the App. We may modify, restrict or discontinue the App with reasonable consideration of your interests.
11) Warranty and Liability
- The App is provided “as is”. We do not warrant completeness or accuracy of content (especially user‑generated content).
- We are liable without limitation for intent and gross negligence, for harm to life, body or health, and under the Product Liability Act.
- For slight negligence we are liable only for breach of material contractual duties (cardinal duties) and limited to the foreseeable, typical damage.
- Otherwise, liability is excluded.
12) Indemnification
You agree to indemnify and hold us harmless from third‑party claims arising from unlawful use of the App or your content (including reasonable legal defence costs) that you are responsible for.
13) Intellectual Property
The App (software, trademarks, designs, provider content) is protected and remains the property of the provider or its licensors. Do not remove legal notices or branding.
14) Termination
- You may stop using the App at any time and delete your account.
- We may terminate for cause or suspend accounts in case of violations.
- Sections 6, 11, 12, 13, 16 shall survive termination.
15) Changes to these Terms
We may update these Terms, e.g. due to functional or legal changes. Material changes will be notified in the App. If you do not object within 30 days, the changes are deemed accepted. In case of objection, we may terminate the usage relationship.
16) Governing Law and Venue
These Terms are governed by German law, excluding the UN CISG. Venue—to the extent legally permitted—shall be the provider’s place of business.
17) Alternative Dispute Resolution
The European Commission provides an Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr. We are neither obliged nor willing to participate in consumer dispute resolution procedures.
